In recent years, food safety incidents occur frequently, the health of citizens isunder serious threat, and bringing about social universal anxiety. In order to strike crimein the field of food safety effectively, the top legislature modified the Criminal Law in2011, adding an accusation:" food regulatory malfeasance." As a dedicating one tohit the field of food safety malfeasance, this crime received wide attention. However,after the establishment of the offense, the statement that resulting major food safetyaccidents or other serious consequences makes the criminal charge is inapplicable inpractice. Recently, government workers have been prosecuted for the offense caused byfood regulatory malfeasance which led to greater social controversy.According to the new accusation and the happening problems in practice, thispaper proposes appropriate strategies in order to promote application exactly andexecution strictly.
