Labor dispatch as a new, special labor relation model, now has beenmore and more adopted by the vast number of employer. The labor dispatchis also called talent dispatch, personnel leasing, labor dispatch, laborleasing, refers to the labor dispatching organization and dispatchworkers labor contracts, according to labor dispatch agreement todispatch the employees to the labor service unit, a special way ofemploying staffers engaged in labor and employment in the unit management,supervision under the control of. Because in labor dispatch and thecorresponding main body has two, namely, labor units and the dispatch ofunits, so the employer liability is different from the general laborcontract relationship.In China, according to the <Labor Contract Law of the People’sRepublic of China>,the labor dispatch unit is the method that theemployer, and the employer for the employees to the actual service-units, it should bear the legal relationship of labor dispatch laborlaw of employer liability.In this articles, combined with the actual case in stages anddifferent situation of the labor contract, the form for the labor dispatchunits take the employer liability according to the law. Andafter the application of the unit, and the accepting entity accordingto the labor dispatch agreement into between the allocation ofresponsibilities.
