The development of labor dispatch in our country is increasingly prosperous,but the abnormal problems are also becoming obviously.Especially the problem of reverse labor dispatch.At present,China's laws systems are not perfect in regulating the acts of reverse labor dispatch,which lack of administrative supervision mechanisms.Many companies use the way of reverse labor dispatch to evade responsibility and reduce labor costs.On the one hand,interests and labor rights have been seriously damaged.On the other hand,because of legal practices'trouble,which is badly useful to the whole country's law-based construction.In addition,facing the labor dispatch disputes,it is more difficult for labors to protect their own rights.When the labors start protecting their rights,companies usually take measures such as terminating labor contracts to make it better difficult to protect their rights.At this point,the definitions of reverse labor dispatch and illegal release will be involved.Based on the above reasons,this article uses Li's labor contract dispute as an example to analyze the focus of the dispute in this case:1.Identification of reverse labor in this case;2.The respondent decided to terminate the applicant's factual labor relationship and assumed responsibility.This article analyzes according to the current laws and regulations and legal theory,and draws conclusions based on the facts of the case.The scheduling action involved in this case is considered a reverse labor scheduling,and the scheduling action should be invalid.The respondent between a technology company in Deyang and Li has a factual labor-management relationship.The defendant's technology company in Deyang is the termination of the factual labor-management relationship.This behavior is illegal and should be liable for compensation.Finally,through a case study of reverse labor dispatch,the problems in China's current reverse labor dispatch laws and regulations are raised.The rise of China should improve the laws and regulations on reverse labor dispatch from the aspects of legislation,certification and classification of responsibility.
