Research On The Rural Social Endowment Insurance Law System

As an ancient agricultural country, China has been majority people depend onagriculture for their livelihood. Since China’s reform and opening up, large numbersof farmers have left the countryside and poured into crowded cities, to participate inurban construction. With the rapid development of economy and the acceleration ofurbanization, the traditional old-age security model in the rural areas is facing newchallenges. Since Chinese village less-developed economy and low level of medicalfacilities, and until now there is no a perfect old-age insurance legislation, thequestion of the rural social endowment insurance is increasingly incisive andprominent. Therefore, a reasonable and effective endowment insurance legal systemwill benefit us to completely solve the problems in agriculture, rural areas and farmers,and also can improve and enhance the rural population in our country’s human rightssituation and level and ease social contradictions caused by the wealth gap.This paper takes legal relation as its focus, comprehensive and in-depthanalyzing the subject and object and their rights and obligations on the rural socialendowment insurance. On this basis, this article gives a brief account of thedevelopment of rural social endowment insurance legal system of China, from the oldagriculture insurance to the new one and finally to the urban and rural resident’sendowment insurance system. This paper finds that the rural social endowmentinsurance legal system in China is imperfect. Several problems highlighted in therural social endowment insurance legal system is that low endowment, inadequategovernment supervision etc.Therefore, by using comparative analysis approach, I analyse the legislationmodel of foreign rural social endowment insurance and try to gain some practicalexperience from the study of advanced system. In combination with legislationpractice of foreign rural endowment insurance and the current situation of Chinesesociety, I think we can take the following ways to perfect the legal system of ruralsociety endowment insurance. We should elevate the legislation level, complete thelegal system, and clear the endowment payment method in the legislation of ruralsociety endowment insurance.
