The Legal System Of Rural Endowment Insurance In Our Country

Endowment insurance is an important part in the social security system, and it is the most important one in the top five social insurance. China is a big country in agriculture, and there are more than80%of the elderly in rural areas. So the rural old-age security is the most important and prominent problem in China’s endowment system. Population aging has brought a serious of social and economic problems, especially brought a serious challenge to the old ages’endowment insurance. Furthermore, the population aging question will certainly has a significant impact on the endowment insurance system, and is related to the balance of the insurance fund. Chinese traditional way of old-age insurance----depend on the land and children are weakening day by day, the dualistic economic structure disparity between the rural and urban, and the rapid development of our country’s industrialization process, showed that the rural endowment insurance system should be quickly establish. In recent years, the economy rapidly development, the revenues rapidly growth, and the government undertaking ability increased, all of them making a contribution to the rural endowment insurance, making it feasible to establish and improve the legal system.This paper analyses the present situation of the rural endowment insurance, and then induce several problems existing in our country, such as lack of the special legislation, the pension insurance coverage is too narrow, financing sources are too single and the rural endowment insurance mechanism is not sound enough. Through in-depth analysis of the causes of our country, to elaborate the reasons from the following three aspects:the economic reasons, the legal reasons and the ideological reasons.German is the first country to establish the endowment insurance law system, so studying the practice of Germany, and to absorb its advanced, we can get a lot of enlightenment. Such as to improve the government’s fiscal subsidies, to find an effective way to safeguard the pension and increase its value, to establish an effective supervision mechanism, and to formulate preferential policies to improve the enthusiasm of the farmers, and then perfect the system of rural endowment insurance in our country.About the improvement of the legal system of the rural endowment insurance, I have got five suggestions, in the first, to establish the legal status the rural old-age insurance system, in the second, to establish a comprehensive system of the endowment insurance, third, to open a multi-channel pension sources to increase farmers’income, forth, to establish a scientific financing mode, and the last is to establish a scientific and effective ways to manage the fund, to safeguard the appreciation level.
