The right to be educated for children with disability refers to thatthe disabled children enjoy requiring the state to provide equal andsuitable educational opportunities and conditions to obtain the basicrights of survival and development according to the laws andregulations, the degree of whose realization is an important indicatorto measure national progress and social civilization. Since the1990sinclusive education based on its advance and inclusion has graduallybecome a core value of education for disabled children, and providesthe theoretical support for the protection of the right to be educatedfor the disabled children all over the world.This paper, on the basis of the theory of the right to be educatedfor children with disability and inclusive education, the disabledchildren learning at school in County Y as the research object,literatures, questionnaires, interviews and others as researchmethods, describes and analyzes the status of realization of the right to be educated for disabled children, involving right of the chance tobe educated, right of conditions to be educated, the right of successto be educated and remedy for the right.The results of this study display two sides of a coin. On the onehand, the whole state of the right to be educated for children withdisability is better than before. For example, children can enter intoschool easier, have valid student status and can be helped oneducation. In addition, the primary schools have the dropout rates,resumption rates and completion rates under control. On the otherhand, there are also many problems, such as discrimination andrefuse against children with disability, unclear of the number ofdisabled children, low enrollment rate, bad identification andevaluation for the disabled, limited choice of opportunity to beeducated, low per student’s expenditure, single form of educationalplacement, shortage of resource like books, classrooms, teacherswith expertise especially at regular school. In addition, there existsignificant differences on rights protection in some aspects betweenregular school and special school.In order to protect the right to be educated for disabled children,some suggestions based on inclusive education are as follows. Firstly,social propaganda on the right to be educated for disabled childrenshould be expanded. Secondly, the relevant legal and administrative system should be improved. Thirdly, education funds should be added.Furthermore, education service system for children with disabilityshould be set up, such as establishing multilayer resettlement mode,including improving learning in regular class, providing additionaleducation services, setting up special funds, upgrading teachingequipment, improving the professional level of teachers and itsqualities, organizing inclusive activities, designing IEP, setting upspecial education resource center, etc. Last but not least,home-school cooperation should be developed.
