Research On The Legal System Guarantee Intern Injury

China’s current intern are so many, and most of them are students, but this special group can not be protected effectively facing accident in their job,which has caused the attention of each respect. In the present legal system of our country, there is no clear legal status of interns, which causes different provisions in different provinces.When the internship students once appear accident, their rights and interests are infringed,. In view of this, this paper innovatively classifies intern by its character as occupation education internship and higher education internship.And then through comparative analysis and theoretical analysis, combining with its characteristics and types, I compare the industrial injury insurance and commercial insurance model. By this process,I get the final conclusion that the use of industrial injury insurance mode on the occupation education internship, and for higher education the stage of commercial insurance model. Based on the above analysis, I research how to improve our interns of industrial injury insurance and the specific system, so as to provide better reference for the relevant department and protect the rights and interests of trainees better.
