Since the industrial revolution, human broke the balance and harmony with the environment because of using the ability of transforming environment recklessly, then the environment pollution problems emerged,so it is imminent to Look for methods to balance economic development and environmental protection.Environmental liability insurance originated in the1960s of the European and American developed countries, is a very typical economic means that has a relatively strong economic advantages in protecting environment and, at present it has become a main way of solving the problems of environmental damages compensation in the world’s major developed countries.The Specialized environmental liability insurance in China firstly held in the1990s, it can not play a role due to various reasons.In general,there is a market failure in environmental liability insurance market of voluntary insurance mode.This article is under the background of "the guidance about enforcement work of environmental pollution liability insurance pilot" issued by he State Environmental Protection Ministry and Insurance Regulatory Commission,on January21,2013.It analyzes the development of the feasibility and necessity of environmental liability compulsory insurance from the theory that the pollution of the environment cost internalization, the public interest theory, theory of public enforcement and environmental liability compulsory insurance development in our country.At the same time,it put forward troubles in the process of development,like there is lack of special laws and regulations and supporting mechanism, enterprise insurance ability is not enough, the respect such as insurance companies operating there are technical obstacles.On the basis of both at home and abroad practice investigation,our country environmental liability compulsory insurance operation are discussed, mainly put forward that our country should be established a multi-level rate system on the basis of the environmental pollution risk regionalization;Needed a special environmental liability compulsory insurance law and effective policy support, establish perfect risk dispersed mechanism etc development suggestions, in order to realize the healthy development of environmental liability compulsory insurance.
