China’s Urbanization Process In Rural Land Expropriation Compensation System Research

More than30years of reform and opening up,Chinese urbanization has acquired the rapid development,and collected a large amount of rural collective land, in the meantime also generated a batch of new social group who farmers lost their land.In the process of rural land expropriation produced a lot of disputes, many farmers petition problems handling cases are caused by the rural land dispute. The current land expropriation compensation system is a product formed in the planned economy era, the government simply by administrative orders to take the place of the market mechanism of rural land expropriation.The farmers’land was a large number of low-cost collection, resulting in the interests of the peasants is a serious violation of. Large number of farmers lost unemployment because of land expropriation, the resulting falling living standards, increasing complaint cases related to land expropriation, extreme events are occurring, such as guangdong wukan event happened in2011, further deepening social contradiction.Hence, we explore the possibility of establishing a reasonable, fair and impartial land expropriation compensation system for our country’s social stability and unity,at the same time building a harmonious society has important significance.This paper consists of five chapters. The first chapter is the introduction, which put forward the background and significance; expound the basic concepts and theories related to this paper and summarizes the research contents and methods. The second chapter is our country land expropriation compensation system and the effect analysis of the situation,compensation standard to Gaoyao City nearly ten years for the first hand information,were compared using the land acquisition compensation standards and land value,analysis for land acquisition compensation standards and unreasonable; the land expropriated farmers compensation for land acquisition, disposal, reveal the hidden land expropriation compensation scheme for farmers. The third chapter, which enumerates the defects of the current land expropriation compensation system, including twelve aspects as follows:1, the lack of land acquisition compensation principle;2,farmers land contract right of property ownership has not been admitted;3, no strict distinction between public and non-public land expropriation, expropriation is serious abuse;4, the collective land property rights the system is not perfect, compensation main body is not clear, the land compensation distribution mechanism is not reasonable;5, land acquisition compensation standards is not scientific, the lack of transparency;6, hearing a mere formality, compensation and resettlement notice procedure is unreasonable;7, the procedure could not give adequate relief;8, land compensation procedures lack of supervision;9, the current land requisition compensation system does not consider the land value-added income;10, urban and rural two yuan of land policy is the root cause of land requisition compensation unreasonable;11, low compensation standard;12, single form of compensation, resettlement measures are not perfect. The fourth chapter, aiming at the defects of the current compensation system, practical, the more comprehensive reform proposals from the land acquisition legal system, administrative system, reform of land requisition compensation and resettlement mode diversification, the perfect social security system of landless peasants.
