| The rural collective land ownership is the most important land right for thefarmer.Right of collective land registration certification can confirm the farmer along-term stable legal safeguard and has the vital significance for the countryside,agriculture and farmers.In this paper, according to the management authority in the secondland survey analysis, summarize the basic characteristics of Jilin province land ownershipstructure and its distribution.Based on the statistical data of the rural collective landownership registration certification and3counties (city, district) survey of rural collectiveland ownership and ownership registration certification, analyses the problems in theprocess of collective land ownership registration certification, put forward ruralcollective land property management countermeasures under the new situation for Jilinprovince.The main conclusions are as follows:(1) Land ownership structure in Jilin Province, the state-owned land accounts for thetotal land area of40%, accounting for60%of the total area of collective ownership.(2) The collective land ownership has the characteristics of diversification, townlevel has the town government and town collective economic organizations;On of thevillage level has the village committee, village agricultural production cooperatives;Insidethe village has the villagers Group.But as the collective economic organizations in the town, the village and inside the village have been in the absence of a state, villageagricultural production cooperatives have been incomplete, members of the villagersGroup have been not stable and so on, all of them result in the town government and thevillagers committee as the subject of collective land ownership in fact, make ruralcollective land management tend to administrative.(3) The main problems encountered in the process of registration is difficult todetermine the boundary, ownership disputes complex; registration consciousness is notstrong, the registration results in a low digital level; documents lost, issuing the practicalsubject the villagers committee does not correspond to the legal subject the villagers groupwhich is required by law; do supervision work has not been in place.(4) At present, the village committee as the subject of the collective land ownership,the first is in accordance with the Jilin Province collective land ownership generally lack;the second is the village committee organization relatively complete, the villagecommittee as the subject of the collective land ownership, not only in accordance withthe reality demands, but also have a certain basis in the legal, policy and technical level.The village committee is the most appropriate subject of rural collective land ownershipwith the present situation in Jilin province under the new situation.(5) Construction of management of rural collective land ownership in Jilin Province.Confirmation is the foundation, put forward to reasonable solutions surroundingownership disputes, establish a property boundary management laws and regulations,strict with the examination of management authority and establish the propertyconciliation system; Registration is the process, increase the propaganda, establishreasonable measures for land registration, and complete the dynamic management of landregistration, ensure the reality and accuracy of land registration information; Certificationis the result, establish collective land ownership’s management mechanism and mode,suit one’s measures to local conditions as the principle, improve the management system;Supervision is the guarantee, the legal definition as a precondition, strictly take control ofvarious departments management authority and collaborative content, establish the fullrange of regulatory mechanism including the external administrative supervision and internal villager autonomy, is conducive to the smooth progress of the right work andensure the results of quality assurance. |
