The Land System is fundamental to the development of agriculture and rural economics. The Rural Land Property Right System, which is the core part of The land System, is a country's legislative arrangement to the Structure and relation of the Land Property in the Rural Areas, Without the perfecting and modernizing of The Rural Land Property Right System, modernization of agriculture and rural economics of a country or a region cannot be achieved. This is more important to China, because we are under the construction of A New Socialist Countryside, and the. The Rural Land Property Right System is a hot topic in theoretical field. In early days of the Reform and Opening-up, the new Land System, including the Household Contract Responsibility System as its main part, promoted to the development of agriculture. However, since the social economy develops, its advantages no longer exist. Moreover, the disadvantages appeared, such as main body is ambiguous, the belonging is unclear, the power is deformed, and the land transfer is not fluent. Consequently, fanners can hardly become the real owner, the Rural Land Property Right System can hardly be achieved, and the development of agriculture and rural economics can hardly remain stable. This thesis is mainly based on the theory of Property Right, and studies the Property Right of land categorized by broad sense. The land includes rural land, rural collective building land land, rural housing land, woodland, grassland, and so on.
