Practice Research And Legislative Proposals On Marine Ecological Compensation In Guangxi

As a comprehensive means to maintain the ecological construction, Ecological Compensation System is widely applied to the land, but still have a lot of blank in the marine ecological compensation. For increasingly severe marine-conversation-state, Marine Ecological Compensation System, as a new means of protecting marine environment, has great significance to improve ecological quality.The Guangxi Zhuang Autonomous Region is the only coastal A. R in China, which has a unique policy advantage, and Beibu Gulf is also one of the best marine environment protection areas in China now. However,the economy is fast developing here, which brings the enormous pressure to Guangxi marine ecology. The existing legal system in Guangxi is not afford to deal with the difficulty. In order to better protect the marine ecological environment, meanwhile, reach to the tend of research on the legislation of eco-compensation, this paper proposed to establish the legal system of marine eco-compensation in Guangxi.This paper will determine the basic content of marine eco-compensation, and reference the law system and measures both from home and abroad, and base on the current situation of legislation and practice of Guangxi in marine eco-compensation. taking, and try to put forward the legislation schemes on marine eco-compensation.This paper mainly uses the method of investigation and documentary, and try to analysis the practice on marine eco-compensation in Guangxi. In the view of marine eco-problems in Guangxi, this paper put forwards the marine eco-compensation legislation suggestions. The paper will be divided into four sections as follows:The first part of the paper will make sure the basic theoretical issues of marine eco-compensation, including the concept and connotation, origins of basic theories, subjects and objects, forms and standards, in order to determine the basic elements of Guangxi marine eco-compensation legislation.The second part mainly introduced the eco-compensation legislation and practice both from home and abroad. Through the introduction of eco-compensation practice and laws in U. S, E.U.Australia and other countries in the world,this paper will explain the these references of eco-compensation systems and practice for Guangxi.The third part is about the practice condition on marine eco-compensation in Guangxi, according to summarized on-the-spot investigation of marine ecological problems in Guangxi. This part mainly includes:analysis of marine natural and social environment condition in Guangxi;exploration of Guangxi marine eco-compensation practice and problems. Through the analysis of the particularity of Guangxi natural and social conditions, this paper will summarize the problems and deficiencies on marine eco-compensation practice.The fourth part is suggestions based on the special conditions of the Guangxi Zhuang Autonomous Region to formulate local regulations. This part mainly includes: Guangxi ocean laws; the basic content of Guangxi marine eco-compensation (principles, characteristics, subjects, objects, form of legislation and standards); design of marine eco-compensation system and the legislation plan of Guangxi; implementation of support measures of marine eco-compensation system. In this part, according to the actual local marine laws of Guangxi, this paper will determine the forms and standards, put forward the improvement and legislative proposals, and implementations, laws and regulations of the Guangxi marine eco-compensation system, and the construction of this system.
