Legislative Studie Of Municipal Solid Waste Pollution Prevention

With rapid urbanization and improve people’s living standards, the rapid increase in the amount of solid waste generation, waste of resources and environmental pollution is worsening. Currently MSW pollution, China has become increasingly concerned about social issues. At this stage, our work for municipal solid waste management is still stuck in the "heavy end of the handle, light source control" stage, which resulted in a lot of irrational governance nowhere consumptive garbage, garbage production continues to increase, and thus the urban environment damage, hindering the improvement of people’s living standards. Our legislation on municipal solid waste pollution prevention and control work is still in its infancy, although the existing laws and regulations on pollution prevention and control of municipal solid waste for the corresponding provisions, but related to the specific legal system, there is a big loophole, lack operability.Based on the solid waste pollution prevention and control of the city to sort out the legislative system, which analyzes the problems, at the same time learn from Japan,Germany and the US success in dealing with municipal solid waste, combined with China’s actual situation, the "Solid Waste Pollution Prevention Law " and " Cleaner Production Promotion Law " as a starting point, has put forward legislative proposals to improve our municipal solid waste pollution, including: the establishment of municipal solid waste pollution prevention legislation philosophy; establish legislative garbage pollution prevention principles of urban life; improve municipal solid waste pollution prevention and control legal system. The article is divided into six chapters.The first chapter preface introduces the research background, significance, research results and research methods of the present paper, the content and innovation.The second chapter defines the concept of municipal solid waste in our country,introduced its characteristics, hazards and inherent value.The third chapter of the current situation from different levels of municipal solid waste pollution prevention legislation in our in-depth analysis, presented its legislative system and the relevant rules and regulations of the existing problems.The fourth chapter describes Japan, Germany and the United States in terms of the status of municipal solid waste pollution prevention and control legislation, and with the current law of comparative analysis.In the preceding chapter to our legal system, based on municipal solid waste pollution prevention put forward a sound proposal, from the concept of legislation, legislative principles, to specific legislative system and the corresponding rules and regulations putforward the scientific, rational and workable concrete suggestions measures.The sixth chapter outlines the important point of this article, the role and shortcomings.
