Research On The Legal System Of Genetically Modified Agricultural Products’ Security

As the rapidly developed products of modern biotech nology, genetically modified agricultural products are used in daily agricultural production for resolving food shortages, environmental degradation and other issues. However, the security of those products is always a controversial subject. The potential risks in the experiment, environmental release and commercial production of genetically modified agricultural products for human health and the environment sparks panic among the general public. Also the current level of scientific technology can not give an authoritative and convincing theory to the safety of genetically modified agricultural products. With accelerated economic globalization, the safety of genetically modified agricultural products ha s been deeply involved in economic security trade, national interests and national security, and becoming a hot topic in politics and economy of international social life by receiving widespread concern of international community.This article concluded that the law is an effective way to protect the safety of genetically modified agricultural products which have the identity of risk and value by starting from the concept and nature of the transgene, analyzing and focusing development status, safety controversy of genetically modified agricultural products. Secondly, this article summarized shortage of genetically modified agricultural products’ policy in legal system, monitoring system, safety evaluation and labeling policy. Meanwhile, after comparing the advantage of genetically modified agricultural products ’ policy in USA, EU and Japan, this article discussed the method to complete the genetically modified agricultural products’ legal system in China. Finally, after learning from advanced foreign legislation situation, this article made comments and reflections to develop the suitable system and institution of law on four aspects: legal system, safety evaluation before sales, monitoring system after sales and punishments and redressment for accidents.
