Rapeseed is one of the most important oil crops in the world, and heterosis utilization in rapeseed is more common. Ogura CMS has the advantages, such as temperature insensitive, complete male sterile and almost all of the rape can be the maintainer line. So the sterile line is of great significance to the formation of the three series in rapeseed for utilization of heterosis. But because of its important commercial potential, the Ogura restorer line reported in the world which can be used in agricultural production are protected by foreign companies or research institutes to declare patents at present. Therefore, it has great significance to develop the Ogura CMS restorer line in our country. The Ogura CMS restorer line R2572 used in this study is provided by researcher Dong Zhensheng. And the 18 homozygous inbred restorer lines were obtained through years of cross improvement and self purification. Because of the lack of foreign protected Ogura CMS restorer materials, the verification methods mentioned in the patent are selected and the molecular markers which are disclosed in the patent are used for the molecular identification of the restorer line R2572. The results showed that the restorer line R2572 had recovery gene Rfo, which was the same as restorer materials reported in foreign countries. By comparing R2572 with the protection of the restorer material by using the identification method of patent results show restorer line R2572 has no marker BolJon which restorer line R113 has, R2572 has no marker BolJon which restorer line R2000, R211, CLR650 has and R2572 has marker PGlint which restorer line R2000, R211, CLR650 do not have. So restorer line R2572 is different from restorer line R113, R2000, R211, CLR650. By comparing it with the protected Ogura CMS restorer materials of pioneer seed company, the results showed that the length of the exogenous radish fragments with Rfo gene which were imported into R2572 were close to NW1717, but could not explain that R2572 was the same restorer material as NW1717. By comparing restore line R2572 with Ogura CMS restore line BLR-038 which belongs to Syngenta, result shows that R2572 has the marker OPY17 which is belong to the third group in patent. According to the patent R2572 does not have BLR1 transposition. So the restorer line R2572 and BLR-038 are different Ogura CMS restorer lines.Because of the test is based on comparison with the results of the markers in the patent,it cannot strongly explain the difference between them. So If further validation is required, we need compare restorer line R2572 with the foreign protected Ogura CMS restorer materials.
