In the Report of the17th National Congress of the Communist Party of China, it wasposed to make progress in building three basic health care insurance system in both urbanand rural areas. The implementation of Social Security Act on July1st2007hasestablished the insurance system, which covered basic health care of the urban and ruralresidents, in the legislative form for the first time. Obviously, it has necessity to carry outmore researches on the issues related to the legal system of social medical insurance.Among the social medical insurance issues, the expense is the biggest concern. Therefore,the research on the legal control of the expense seems to be particularly important.This paper contains the introduction, the main body as well as the conclusion, themain body is divided into four parts:The first part of this paper is an introduction to legal control of social medicalinsurance expense in our nation. In this chapter, on the basis of reasonably definedconcepts, the author makes an analysis on the expense growth tendency and lists thereasons. And the author farther states the necessity of its legal control.In the second part, the experience shows how the legal control of the medicalinsurance is practiced overseas. This chapter mainly digs deep into the experience of US,UK, Germany and Singapore. The author tries to seek some inspiration and adapt it todomestic practice.In the third part, the problems popping up about current status and presence of oursocial medical insurance are specifically discussed. In this chapter, the author gives outan account of its current legislation and draws a conclusion that our nation shouldimprove the laws on the expense of the social medical insurance and add up items tothe laws and regulations on the expense control.In the fourth part, the author provides some suggestions to improve our legal controlof social medical insurance expense. The author offers some insights into strictlydeclared responsibility taking, the payment system, strictly controlled expenses, settingup regulations for the systematical as well as the effective legal supervision.
