In the 1920s, after ten years of exploration and practice, on the one hand, the constitutional politics of The Republic of China faced with a new development opportunity, for example, the congress was more active and taken more seriously than ever before, the interaction increased among the congress, the cabinet, the president and the court for the reason that the congress Undertake the task of the next presidential election and The formulation of the constitution. on the other hand, under the background of domestic strife and foreign agression, the whole country filled with nationalism, the chinese people becomed more radical. They wered not satisfied with the slow process of the constitutional politics, but prefered the party politics of Soviet Russia, and started to give up the constitutional politics. China became in a turning period when the party politics replaced the constitutional politics. It happened to the case of Luo Wengan, which refered to the congress, the president, the court,the cabinet and so on. In the begenning, the congress battled with the cabinet with the help of the warlords. It was easy for us to find that the cabinet collapsed under the joint attack between the congress and the president. The case of Luo Wengan was Finally settled through judicial process. The defendant was the finance minister, who had ever been the judicial minister.It was so special that the judge couldn’t deal with it easily. More importantly, there were many political forces in the behind of the judge. For example, the judges wanted to strive for judicial independence, But the warlords and politicians attempted to intervene the justice. At the same time, the public opinion played an important role in the case. Through the case of Luo Wengan, we can find the running status of the constitutional politics and the watchdog function of the public opinion. It could help us explain the historical destiny of the constitutional politics in the early years of the Republic of China.
