Research On Balance Measures Between Knowledge Sharing And Copyright Protection Of Copyright Collective Management

Since the 20th century,90 decade, as the extensive application of information technology, network technology, digital technology, a fundamental change occurs in the reproduction and dissemination of works, the cost of that has been greatly reduced. This change, while creating favorable conditions to share knowledge for the public, is triggering a series of social problems at the same time, the most prominent problem is the relationship between copyright protection and the knowledge-sharing. Copyright represents personal interest, knowledge sharing represents public interest, in promoting the process of knowledge-sharing and cultural exchange, the conflicts between information owner and user is increasingly prominent. In this case, how to coordinate the conflict between the sharing of resources and knowledge copyright protection, and restore the interest balance between the copyright owner and the public, has become the focus of scholarly research. From the perspective of collective management of copyright, this article studies the copyright collective management organizations at home and abroad, researches the balance of knowledge-sharing and copyright protection measures taken by these organizations, sums up the management and technical measures of copyright collective management organizations in the balance of knowledge sharing and copyright protection. This paper is divided into six parts:The first part introduces the research background, research objective, research significance, research situation, the research content and the innovation points, etc.The second part analyses the relationship between knowledge-sharing and the copyright protection of copyright collective management, including the conflict between knowledge sharing and copyright protection, the origin and development of copyright collective management, the effect of copyright collective management to the balance of knowledge-sharing and copyright protection and the related concepts about the copyright collective management.The third part researches the balance measures’ characteristics about knowledge sharing and copyright protection of domestic and international copyright collective management organizations.The forth part researches the balance measures—management measures of the knowledge sharing and copyright protection of the world collective management organizations through member management, the usage modes of works permitted, works licensed fees and licensed royalties distribution.The fifth part researches the balance measures—technical measures of the knowledge sharing and copyright protection of the world collective management organizations, including the international unified works description standards, the management platform of copyright information, the copyright online management platform.The sixth part is the conclusion part of this article, summarizes the preliminary results, the shortcomings of the paper and the later research prospect.
