Research On Copyright Protection In The Operation Of Knowledge Sharing Website

Since MOOC entered China in 2012 and the development of information technology,the knowledge sharing website has attracted a large number of learning enthusiasts and has continuously generated more online learning needs.Shortly after the implementation of the "Copyright Law"(the second amendment)on April 1,2010,on July 14,2011,the National Copyright Administration and the General Administration of Press and Publication held the third revision of the "Copyright Law" in Beijing and the appointment of experts.The ceremony immediately followed on January 30,2013 when the government issued the "Regulations on the Implementation of the Copyright Law"(the second revision).The actions of the country inspire the author of this article: Are many issues of copyright protection in the operation of knowledge sharing websites related to the rapid changes of society? The main problems studied in this article are the unreasonable copyright transaction conditions encountered in the operation of knowledge sharing websites,the risk of infringement of the use of other people's works,and the difficulty of rights relief.In the analysis of each problem,the current environment and the development direction of national laws are combined as much as possible to try to find a more reasonable solution,so that the knowledge sharing website can operate more smoothly.This article mainly includes the following five parts:The first part leads to three problems urgently needed to be solved in China's knowledge sharing websites.At the same time,it introduces the research significance of this study,combs the current research status at home and abroad,and explains the research ideas and methods adopted in this article.In the second part,by defining the scope of copyright protection of the knowledge sharing websites discussed in this article,it briefly explains the characteristics,development background,protection status and dilemma of the knowledge sharing websites.The third part solves the problem of unreasonable copyright trading conditions of knowledge sharing websites.First,analyze the problem,extract the two reasons for the dominant position of the operator,the spiritual benefits of the work have huge potential economic benefits,then look for the analysis of relevant advanced experience,and then propose the matching of the current system and its development and maintenance should be absorbed by advanced experience.Two basic positions of the people's interests,and finally put forward countermeasures.The fourth part solves the risk of infringement on the use of works on knowledge sharing websites.First,analyze the problem,extract the two reasons for the limitation and lag of therights restriction legislation,and the "notice-delete" rule,and then look for the analysis of advanced experience in business and administration,and then propose what should be learned from the advanced experience.Based on the position of the law revision direction and existing policies,finally put forward countermeasures.The fifth part solves the problem that copyright owners are faced with difficulties in remedy of rights.Analyze China's existing advanced experience in business and administration,and then put forward the necessary basis for absorbing advanced experience,taking into account the interests of all parties and introducing public relief in the field of copyright,and finally put forward countermeasures.
