On The Law Issues About The Environmental Finance In Rural Of Our Country

Since the mid-twentieth century, with the rapid development of science and technology, Human beings have been creating social wealth as well as material civilization with unprecedented pace. However, they have been severely damaging earth’s ecological environment and natural resources simultaneously, the serious environmental problems have alarmed them. Under the condition of developing low carbon economy globally, Environmental Finance has been the most effective integrated mode of sustainably developing economy and environmental protection. The ecological civilization and environmental protection in rural areas affects the development of ecological civilization of society. For a long time as well as the development of the economy, environmental protection in rural areas has always been in poor situation. The vulnerability of the rural ecological environment itself and the status of environmental degradation impede the economic and society developing sustainable, healthy and stable.According to the information aboved, the theory of the right of Farmer’s environmental and financial has come up innovatively with the combination of legislative value concept of "two types" social construction, with the target of salient environment pollution problem in rural areas, from the perspective of multi-disciplinary such as Law, Finance, Management, sociology, History and so on to analyze the environment and finance in rural areas, with the introduction of market mechanism and usage of financial method based on traditional governmental supervision to solve environmental problems in rural areas, and on the basis of the theory of famer’s financial right and environmental right.By means of comparative research and analysis of the concrete measures of environment and finance of rural areas in typical countries, the generalization of relevant experience is made to provide reference of solving the concrete legislative problems concerning rural environment and finance in our country. The typical economic incentives used by foreign countries are environmental labeling system, carbon taxes and fuel tax system, levying fees of noise pollution and traffic congestion costs, pollution levy system and the environment deposit system. These typical measures in foreign countries has been recognized and implemented in many countries, and have good environmental effects. However, these measures in China is still in its infancy, a number of economic incentives have not been implemented yet.To analyze the status quo and main problems aspect s in law aemerged in the development of rural environment and finance in our country,so as to profoundly research the rooted reasons. The mainly Issues existing as follows:the absence of emissions trading systems, investment and financing mechanism is not perfect, the rural environment insurance system is not supporting and local government regulation weak, etc.; analyzing the causes, the root are severe financial repression in rural areas, rural environment regulatory mechanisms are inadequate, the legal protection of rural environmental protection investment and financing system is not perfect; other obstacles of factors as follows:good policies and market environment are in short supply, internal and external incentives and monitoring mechanisms are not perfect, the mechanisms of information sharing and exchange terrace of energy saving in financial services is not clear, a lack of highly appropriate environmental standards, the constraints of the management system between urban and rural and other factors.In actual measures to tackle the issue, we come up with the concept of complying with low carbon economy and scientific development, the principal of complying with interest consultation and balance as well as risk precaution and control.As far as the concrete measures are concerned, we have come up with establishing the right of dealing mechanism of county regional swage disposal, perfecting the mechanism of sustainable investing regarding to environment protection in rural areas(rural sustainable bank business、rural environment fund、rural environment deposit、perfection of capital raising mode of rural environment protection included), establish the legal regulatory systems of the main of environment financial in rural.
