The Study On The Right To Know In Our Country

The right to know is a new type of human rights, the right to know has been written to themajor international human rights conventions, many countries around the world have givenlegal protection to the right to know as a citizen’s basic rights. The theoretical basis of theright to know is the principle of popular sovereignty, the rights and powers of the dynamicbalance is the reality basis of the right to know. The right to know is the premise of theexercise of other rights of freedom of expression, to supervise, is an important means of civicsurvival and development. The right to information include in the private law and public law,the paper mainly discourse the right to know in discourse public law.The realization of the right to know requires the main obligations to fulfill publicobligations, but lacking the consciousness of protect the right to know cause authority inpublic, judicial openness and the openness of government information is not complete. Inaddition, the legal system of protecting right to know is not perfect. Currently, there is noright to know in our Constitution as the citizens’ fundamental right, the right to knowprovisions scattered among the various laws and regulations, lack of protection of the right toknow. Government Information Ordinance2008has a significant role to protect citizens’ rightto know, but still need to continue to improve.Protect citizens’ right to know is the needs of protecting human rights, is an importantmeasure to curb corruption, is an important channel for developing democratic politics andbuilding a harmonious society. In order to protect the right to know,we needs to be right toinformation in the Constitution, given the right to know the highest legal protection from theconstitutional level; at the same time should improve the department of the protection of theright to know,making the legal provisions more specific and operational; erfecting the reliefsystem of right to know is able to give strong protection when the right to know infringed;improve the propaganda of right to know and increase citizen awareness of rights, play therole of social organizations.
