The Research On China’s Easements System

Easement is an important system of property law.In the condiation of pursuing the “legaland property rights”, easement system with its unique flexibility, inclusiveness has played amajor role in the use of the real estate. As an old system, the easement is generally adopted inthe civil law and common law.In2007,the system of easement was established in our“Property Law”.It has improved our property rights system and reflected the needs of thesocial reality,but there are still some problems that need to be perfected.In the preparation of this dissertation,the author adopted the historic approach,thecomparative approach and the legal approach to analyze the problems related to theeasement.Divided into the following section:Part One: The basic theory of the easement is discussed in the legal approach. Themeaning, function and evolution of the easement are analysised, focusing on the unique valueand its new development.Part Two: Using comparative analysis, the author makes an introduction on the easementof other counties, to perfect our easement.Part three: the lack of our easement. This section describes the status and the problems ofchina’s easement.Part Four: Recommendations of easement perfection. This part describes the guiding ideologyand the recommendation of china’s easement system.
