China has become the superpower which both produces and sales the automobile in theworld. The popularity of cars increases people’s quality of life, but also brought a series ofproblems.Difficulty of parking has become a modern city residential universal problem, whichleads the disputes among owners, between owners and developers. Ownership of residentialparking garage has become the focus of community issues. To solve these problems as soonas possible and to improve relevant laws and regulations are very important to the goodrelationship of the neighborhood and the social harmony. The theoretical circles in chinaremain a lot of controversy for the residential parking garage. Each theory has its own truth,but it is not perfect. There are also some drawbacks. Academia has not yet reached aconsensus.This thesis includes seven chapters. The first chapter is about the outline of theresidential parking garage and legal nature. In this thesis, atheoretical analysis, comparative research methods and theory with practice are employed. The writer learns from the law, sociology, economics and other research results. Views on theimproving legal system are proposed. The thesis also includes the establishment of acomplete system of property registration and drawing patterns on residential parking garagewhich can lead to the classification regulation. From this thesis, we can also find out theappropriate guidance and other measures from the government, which are helpful to maintainmarket stability and ensure the fundamental interests of the people in order to promote socialharmony.
