Qualitative Research Of The Case That Liu Mou And Liu Mou Organize The Theft

In2009, a new crime the crime of organizing minors to violate the public securitymanagement was set up. The establishment of this crime is of great significance forprotecting the legitimate rights and interests of minors and maintaining social order. Thecrime involves much content. And some of the content is not explicitly specified by thejudicial interpretation. So it will be difficult to apply the crime to practice. The study onthe crime can not only make the crime a clear understanding, more importantly,accurately judge cases related to the crime. This paper revolves around the identificationof a case related to the crime. The full text is divided into five parts.The first part is the introduction of the paper.The second part expounds the fact of the case as well as four different perspectivesof identifying the case. By analyzing these four viewpoints, a preliminary analysis ofthe case is obtained.The third part is the corresponding research of the crime of organizing minors toviolate the public security management. This part is divided into three aspects. The firstaspect expounds the establishment of the crime and the legislative significance. Thesecond aspect elaborates constitutive elements of the crime. The subject, the subjectiveelements, the object and the objective elements of the crime are discussed. Especiallythose controversial views are judged. The third aspect expounds the relationshipbetween the crime of child abduction and this crime and between organizations ofpersons with disabilities, children begging crime and this crime.In the fourth part, two issues that the four views of this case do not evaluate arediscussed. One is how the behavior Liu Mou and Liu Mou direct students to break carglass is identified. Another is whether Liu Mou and Liu Mou constitute the crime ofimparting criminal methods.In the fifth part, by the previous analysis, the conclusion of this case is concluded.
