Since the reformation and opening to the rest of the world, a great deal ofunprecedented developments of such social programs as politics, economics, culture,sports, technology and education have taken place in China. In the meantime, with theboosting of the socialist marketing economy, some kinds of crime in new types or newforms emerge in endlessly. This particularly goes to bribe-taking.Given the current circumstances, the Supreme People’s Court and the SupremePeople’s Procuratorate jointly enacted the judicial interpretation “Opinions on SeveralIssues about Applicable laws When Dealing with Cases with Bribe-Taking”. It offeredthe guidelines for several issues of some typically new types of bribe-takings in juridicalpractice. Furthermore, it provides the judicial office with the significant legal groundswhen they investigate the bribe-taking.In the new ear, it goes even harder to anti-corruption. Both the Communist Partyand leaders of China size up the situation prop up anti-corruption and firmly implementthe policy of “no tolerance to corruption”. All above, in order to accord with thesituation of demanding of the elimination of corruption, the author holds that itnecessary to classify and clear the relevant issues of the new types of bribe-taking.The essay covers three parts: the preface, the body part and the conclusion. Themain body part contains four chapters: the first chapter mainly discusses the affirmationof bribery amount and the bound of crime and non-crime in a transaction; the secondchapter analyzes the connotation of “performance shares” and other disputes aboutbribery amount in judicial determination; the third chapter analytically demonstrates thedefinition of the bribery in cooperation and investment; the forth chapter deals with therelated problems of the affirmation of the special related person’s bribe-taking.
