The Analysis Of The Cases Of The New Types Of Bribery

Crime of corruption and bribery is a worldwide economic crime. In China, with the development of economy, this type of crime is also showing a rising trend, and presenting some new features. Compare with the traditional types of bribery, the new types incline to be more subtle and complex, which cause some controversy in the process of justice. In this condition, the Supreme People's Court and the Supreme People's Procuratorate jointly issued "Regulations on the law applicable in criminal cases for bribery" in July,2007; the issue provides a legal basis to fight against the new types of bribery effectively. This letter, reference to the issue above, through the use of case study, literature search, logical analysis and other methods, dissects the new types of bribery in the transaction, special relationship, and co-investment, and make the author's own methods and suggestions, which maybe contribute to the progress of the combat on the new types of bribery.The article is divided into two parts. The first part focuses on a group of related cases with Ma Ping, Zhao Zhanqi and He Xiaoyin, which analyzes the bribery of transaction, special relationship and co-investment, further deepening the understanding of these new types of bribery, then explores and studies the problems which are not involved or controversial in the issue. The second part, based on the atmosphere of China's accession to "The United Nations Convention against Corruption", raising some recommendations of legislation, in order to fight against the new types of bribery better, purify the environment of economy, and safeguard social equity and justice.
