Studies On The Legal System Of Supervision Of Public Trust

Public trust is a legal system is very characteristic of Anglo American law, plays avery important role in the development of social welfare in many foreign countries.Introduction of public trust system in our country, its development is still in its infancy,is also not perfect each system, especially supervision over public welfare trust hasmany problems. In this paper, combined with the public trust supervision system oftheory of common law system and continental law system, from the perspective oflegislative and administrative supervision, carried on the analysis to the problemsexisting in Chinese public trust supervision system and proposed the correspondingperfecting suggestion. This paper is divided into six parts:The first chapter is the trust and the public trust. The chapter on the origin of trustwas introduced, and then the theory and legislation of trust and the public trust fromdifferent perspective of the concept of legal definition, the law of public trust aresummarized.The second chapter is the supervision of public trust. The first chapter of public trustsupervision concepts, and then discusses the necessity and mode of regulationsupervision of public trust, finally introduces the main contents of supervision of publictrust, namely regulatory, operation supervision, termination of supervision, and pave theway for the following.The third chapter set up the supervision legal system for the public trust. Thischapter were discussed from the two aspects of the establishment of public trust—thereal conditions and procedures.The fourth chapter is the public trust operation supervision legal system. The management andthe use of supervision, from three aspects of the trust property management regulation、information disclosure system and the public trust change,has carried on the elaboration to thepublic trust operation supervision legal system.The fifth chapter is the public trust terminates supervision legal system. In thischapter, the causes of termination and the public trust terminates the program from twoaspects are introduced.The sixth chapter is the main problems existing in our public trust supervisionsystem and its perfection. This chapter mainly from the two aspects of the legislativeand administrative supervision of the supervision of public trust existing our systems oflegal problems was analyzed, and put forward the improvement suggestions.
