On The Construction Of A Felony Criminal Settlement Trial Stage

Criminal reconciliation as a new model of justice, showing the model solves the problem ofcriminal advantage. The March14,2012revised "the people’s Republic of China CriminalProcedure Law" established a reconciliation of the litigants of the public prosecutionprocedure, formally recognized the legitimacy of criminal reconciliation, but the scope ofapplication is limited to misdemeanor cases. The possibility of application of the criminalreconciliation felony cases, there are some disputes in the academic, practitioners havealready tried. From the good social effect of judicial organ on the applicable criminalreconciliation felony cases received, I agree with felony applicable criminal reconciliation,but because of a felony applicable criminal reconciliation procedure may have some negativeeffect, so it must be the applicable to strict limits. In this paper, trial stage from theperspective, significance, feasibility analysis a felony criminal settlement, to explore a felonyin trial stage of the criminal reconciliation in the building, and finally formed a more perfectwith Chinese characteristics of the criminal reconciliation system.
