Research On Legal Issues Of Copyright Collective Management

Copyright is a private right that should be exercised by copyright owners inprinciple.But the developments of science and technology make the individualmanagement quite incapable for the copyright owners,as the result,the copyrightcollective management come into being.Copyright collective management system refers to the authorization of thecopyright owner of the copyright collective management organization to accept, grantlicenses to users, fees and between the holder of the allocation system.In the process of copyright collective management system running, the copyrightowner, collective management organization, various legal relationships between users,at the same time produce a series of legal problems. This article from the Angle of law,focusing on copyright collective management system of a controversial law andjudicial practice problems for analysis.The whole thesis has four chapters.The first part analyzes the overview of copyright collective management system,the concept of copyright collective management system of general, legal nature, andthe necessity and significance of the existence of copyright collective managementsystem is presented.The second part is the legal relationship of copyright collective managementresearch, which is very important in this article. This part mainly analyzed therelationship of collective management group and copyright owners, users, and thelegal relationship between collective management organizations. This paper studiesthe authorization and the holder of the relationships between properties, and the usersfocus on the fee standards, charge distribution, between the collective managementorganization of legal relations between them are discussed qualitatively.The third part is mainly analysis the copyright collective management system ofthe type, and introduce the typical countries’ model. Copyright collective managementsystem are briefly discussed in the generalization in the development of countries.Thecollective management mode is divided into three broad categories existing incomparison.The fourth part is mainly aimed at problem of copyright collective management organization in our country.And inducing and putting forward the concreteSuggestions, such as improving the system of collective administration of copyrightextension, and establishing the special dispute settlement mechanism, strengtheningthe propaganda, enhancing the copyright owner’s awareness, etc.expecting to improvecopyright collective management organization system in China.
