Study Of Housing Ownership Identification And Segmentation Problems In Divorce Cases

On July14，2011，"the Supreme People’s Court on certain issues concerning the application of<People’s Republic of China Marriage Law> interpretation (c)"(hereinafter referred to as the"marriage law interpretation (c)")has adopted. In some ways, it improves the marital propertysystem, and is of great significance to solve the divorce division of property, but it can notcompletely solve the various relationships of marital property in real complicated life.Therefore,the study of housing ownership identification and segmentation is still very necessary.In addition to the introduction and conclusion, there are three chapters. It is focused on moredisputes in real life and judicial practice of several classes of real estate investment, ownershipform and how to partition etc. Based on the principles and methods of summarizing the presentconjugal property system, several kinds of typical housing segmentation problems are solved.The first part of this paper describes the basic theory of current housing ownershipidentification and segmentation. It analyzes the problems of property ownership in the presentconjugal property system between husband and wife. And it is the study between China’sproperty law and marriage law about the couples housing rights. The second part is mainlycarries on the analysis focuses on the detailed on several typical housing property ownershipand the existing problems of segmentation. The third part is put forward concrete suggestionsand measures on the basis of summarizing above.
