As an integral part of China's housing security system,China's economically affordable housing system has played an important role in solving the housing problem of low-income families in China in the past 20 years of development.The promotion has effectively curbed the soaring price of commercial housing and promoted the healthy development of China's real estate industry.However,the drawbacks of the economically affordable housing system are also increasingly apparent.The introduction of the common property rights system in China and the pilot in the local area are an effective solution to the improvement of China's economically applicable housing model.China's common property rights system started late in China,and it is still in the stage of exploration and pilot.The common property rights system of affordable housing has achieved obvious results in the current pilot cities,but there are still some defects to be improved.It mainly studies and analyzes China's economically applicable housing system from the perspective of legal system,and tries to propose relevant countermeasures from the aspects of the soundness of the legislative system,the improvement of the operational management mechanism and the optimization of the supervision mechanism.The article contains the following four parts:The first part is the basic theory of the common property rights system of affordable housing.First,the related concepts of the affordable housing system will be elaborated.Then analyze the legal basis,the main legal basis is the share of the civil law.Finally,the necessity of perfecting the common property rights system of affordable housing is discussed.The second part is an overview of the status quo of the common property rights system of affordable housing in China.This part mainly analyzes from two aspects: one is the relevant legislative provisions of the common property rights system for affordable housing in China,and the other is Huai'an City and Shanghai as examples.Then the conclusions drawn from the analysis of the current situation of China's system are mainlydue to the lack of the legislative system,operational management mechanism,supervision and management.The third part is the experience of the common property rights system outside the domain.Through the introduction of the common property rights system between the United Kingdom and the United States,it reveals the successful experience of the common property rights system between the United Kingdom and the United States.The fourth part is to improve the common property rights system of affordable housing in China.This part mainly proposes the improvement of China's economically applicable housing common property rights system from three aspects: the improvement of the legislative system,the improvement of the operational management mechanism and the optimization of the legal supervision procedures.
