Political system is the fundamental institution of a country or a region. Itgenerally refers to the sum of political settings in which the operation of politicalpower is at the core. The basic framework and content of political system areprescribed by the constitution or constitutional law. Through a comprehensiveanalysis of the content and features of the Hong Kong Basic Law, this dissertationexplores the history of Hong Kong’s political system, inquiries difficult situation ofHong Kong’s executive-led system and puts forward suggestions and countermeasuresto improve executive-led system in practice. Starting with historical experience ofHong Kong and development trend of world’s political system, this dissertation aimsto clarify the foundation of Hong Kong’s executive-led system and proposes legalrethinking to improve executive-led system from the perspective of Hong Kong BasicLaw.This dissertation can be divided into five parts: Firstly, the overview of theHKSAR ’s political system, including the origination and principles of the HKSAR ’spolitical system and some related concepts about the executive-led system, such as“the executive-led and dominated by legislature”,“executive-led”,“Chief ExecutiveSystem”. Secondly, the SAR ’s political system characteristics, including the centralposition of the Chief Executive, legal status of the Chief Executive, extensive powersof the Chief Executive, separation of powers but focus on cooperation and judicialindependence under dominance of administration. Thirdly, the status quo of HongKong’s executive-led system, including the problems and current situation of it.Fourthly, suggestions and strategies to improve the political structure of the HKSAR,including strengthening the capacity of the Chief Executive-led, clarification andcoordination the relationship between the executive and the legislature, judicialprotection administration under the leadership of independence. Fifthly, summarize the status of Hong Kong executive-led system in practice in order to look forward tothe future of executive-led system.
