System of penalty reduction is a distinctly important execution of punishment system ofChinese legal institution. It is an important method to improve prisoners comes back to thesociety. System of penalty reduction, as a significant component of execution of punishmentsystem, roles invaluable function in judicial practice area. It has significant function in3phases, combining punishment with generousness, transforming passive factor to positivefactor and achieving effective penalty purpose. Because of its feature of flexibility, repeatedapplicability and consecutive inspiration, in generally, judicial office makes it as the effectiveadjustment measure leads to the negative effects inordinately. At the same time, prison workpractices told us there’re operational problems of the system of penalty reduction. Therefore,it’s necessary to inspect the system of penalty reduction again to perfect relevant stipulationand to improve its operability. Base on this situation, author explores and researches thesystem of penalty reduction by combining theory with practice to complete and make itscientific and reasonable. Author points of the view of prison enforcing practice and statessome contents including development situation of the system of penalty reduction, existingnecessary and negative effects. This paper analyses modifying criminal law to effect prisonreduce penalty and the problems in prison enforcement practice. Author point out his view inpenalty reduction legislation, ahead of supervision, open trial, criterion procedure, afterpenalty reduction system and so on. In conclusion, this paper purposes to analyze the systempenalty reduction from the aspect of prison enforcement practice. Perfecting this system isbenefit to manage prison and inspire convicts to reduce penalty.
