Supervision Of Punishment Execution Of A Number Of Issues

As the theories studies developing, the distance between the theories and the practice of the supervision systems of penalty enforcement is increasing. On one hand, the theories studies not only request the legal supervision systems of penalty enforcement to carry out its basic function: to guarantee the lawful penalty enforcement and maintain the impartiality of justice, but also request the system to carry the concrete principle into the penalty enforcement, such as to use the right of the penalty enforcement properly, enhance protection of human rights. On the other hand, some new problems existing in the system of penalty enforcement hinder seriously the practice of the system, these problems are: there is an absence of supervising subjects; the functions need to be amplified further; the relative rules and regulations are not scientific; the procedure of the supervision is not scientific etc.The second chapter of the text mainly analyzes the present condition and its reason of the supervision system of the enforcement penalty in the areas of the supervision subjects, supervision function, supervision method and the authority of the supervision system. The write stated the main reasons resulting in the present condition: the absence of an integration of the criminal execution law, over-separating the power of supervision into too many subjects and the lack of the compulsive execution force.The third chapter of the text mainly stated the suggestion to improve the system in our country. On the basis of realizing the target of an integration of the penal execution, the writer brought up such proposals to establish the integration of the criminal execution system as to push forward the legislation of the integration of supervision rules and regulations, to establish an unified supervision body and perfect its internal mechanisms, to guarantee the compulsory force of the supervision system, and to promote the efficiency of its personnel. The supervision system should include life sentence, non-custodial sentence and custodial sentence according to the power and characteristics of the supervision system.
