Research On Control Measures Of Discretion Of Base Price Law Enforcement Personnel

The base price law enforcement personnel is responsible for protecting legitimaterights and interests of consumers and business operators, the maintenance of normal priceorder task and promoting the healthy development of the socialist market economy. Inorder to better play the role of price law enforcement, the people give the important powerof discretion to the base price law enforcement personnel. With the development ofeconomy and the continuously deepening of legal society’s constructing, The discretionimproper use problems of price law enforcement gradually exposed. How to correctly usethe discretion of base price law enforcement personnel, has become the most urgent task.The paper analyses the definition and characteristics of price law enforcementdiscretion; by analyzing the practical significance of street level bureaucrat theory andChina’s price law enforcement discretion existed, proved the necessity of the existence ofprice law enforcement discretion; identifying the discretion of price law enforcement inthe right price principle of legality and rationality of the use of principles. Using theliterature research method and case study method, this paper uses the behavior on thediscretion of base price law enforcement personnel are analyzed from two aspects oflaws and the current law enforcement, found the problem of no right, abuse of base pricelaw enforcement personnel using discretion. The problem have seriously damaged thedignity of the national law, violated the legitimate interests of the relative, made against tothe establishment of the healthy development of the socialist market economic order, andwill encourage the privilege thought and corruption, influence the healthy development ofprice law enforcement team.In view of the urgent need to address the problem, this paper from two aspects ofexternal, internal reasons, and find the external measures and internal control measures ofthe base price law enforcement discretion. The external measures include improving thesystem and perfecting the procedure, such as the discretion criterion system, major casesof collective discussion system etc. The internal measures include improving personnelquality and enhance staff awareness, such as strict management of staff input, confirm power and responsibility etc. A series of feasible measures can use discretion on base pricelaw enforcement personnel effectively control the behavior of prices, to better achieve thepurpose of law enforcement and the use of discretion of intention.
