Studies On Control Of Civil Aviation Administrative Law Enforcement Discretion

The existence of civil aviation administrative law enforcement discretion is an inevitable result of administrative power expansion and the law itself cannot end every possibility.Reasonable discretion is an essential and effective method for administrative organization to use the administrative power,and it's very helpful with increasing the administrative efficiency and achieving the fairness and justice.In order to ensure that the civil aviation administrative organ could exercise the administrative law enforcement discretion correctly,it's very important to specify and manage the use of administrative law enforcement discretion.This can promote the sustainable and safe development of civil aviation,and achieve the purpose of the civil aviation administrative legislation.This is the purpose and research significance of this dissertation.This dissertation makes a deep study on the discretion of civil aviation administrative law enforcement,explains the definition and particularity of civil aviation administrative law enforcement discretion,analyzes the necessity and problems of the civil aviation administrative law enforcement discretion,and discusses the methods to control the civil aviation administrative law enforcement discretion.In this dissertation,empirical analysis method and comparative analysis method are used for civil aviation administrative law enforcement discretion study.The dissertation is made by five sections:Section 1 describes the literature review,background and innovation etc.;Section 2 describes the necessity,definition,particularity and classification of civil aviation administrative law enforcement discretion;Section 3 describes the problems and main reasons of the civil aviation Administrative law enforcement discretion;Section 4 describes the methods to control the civil aviation administrative law enforcement discretion;Section 5 is the conclusion of studies on control of civil aviation administrative law enforcement discretion.These are the conclusions of this dissertation.First,the research of this title has strong theoretical value and practical significance.Second,the civil aviation administrative law enforcement discretion has its own existence necessity.Third,the major causes of the civil aviation administrative law enforcement discretion abuse are its own reason,civil aviation administrative law enforcement team reason and management system reason.Last,this dissertation provides some improve countermeasures.
