Legal Research On Property Relations Of Non-marital Cohabitation

With the development of economy and the progress of the society, people’s ideasare gradually changing. Non-marital cohabitation is stepping into people’s lives, besides,the cohabitation is more and more prevalent and widely accepted. It has seriouslyimpacted our traditional ideas of marriage. Facing the fact, different countries in theworld have different reaction on the law. On the whole, they are now accepting thephenomenon and protecting it to a certain extent. However, China avoids facing thenon-marital cohabitation. This attitude not only failed to reduce or prevent theemergence of the phenomenon of Non-marital cohabitation, but this phenomenon hascaused more and more social problems. Especially problems of Non-maritalcohabitation property relationship are highlighted increasing. So, In order to protect theharmonious development of society and perfect the improvement of the legal system, itis necessary for us to adjust the phenomenon by law in combination with China’snational conditions and foreign experience in legislation to solve the problem ofNon-marital cohabitation property relationship. The author tries to provide new adviceon the phenomenon, in order to perfect the law system of our country.The paper is divided into five parts:Part1: It explains the basic theory about Non-marital cohabitation, including theconcept of Non-marital cohabitation. the difference between other similar concepts andthe cause of Non-marital cohabitation. It will lay the foundation for the back of thetheory.Part2: It introduces the property relationship of Non-marital cohabitation. Andthen we mainly study the specific problems and the status of Non-marital cohabitation.Part3: According to the comparisons of regulations on the property relationship ofNon-marital cohabitation between the two law systems, we know more about the law ofNon-marital cohabitation in America and France and then we choose which can be usedfor reference of the construction of the system in China.Part4: It analyses present law about the property relationship of Non-maritalcohabitation of China. And it also draws the defects of the law. We can provide newthought according to the result.Part5: It shows some new measures for the adjustment of property relationship ofNon-marital cohabitation in China. Based on the above analysis, it concludes the basic principles of legal regulation about Non-marital cohabitation. In the end, in order toestablish and perfect the system, we put forward some constructive suggestion on theproperty relations of Non-marital cohabitation.
