The Research On Conflicts Of Jurisdiction Of Transnational Corporation’s Environmental Infringement

Transnational environmental infringement is not strange, there are many caseshappened around the world, especially in developing countries. And then the firstproblem is its jurisdiction. In this paper, we study mainly for transnationalparent-subsidiary company and not to the parent company and its branches.Jurisdiction is the core and the center link of international private law, also is the keyproblem in recognition and enforcement of foreign judgments, is related to a country’sjudicial sovereignty, and directly affect the case applicable law and the real result.This paper mainly introduces in detail the jurisdiction of the transnationalcorporations’ environment infringement. It enables us to have a clear understanding,and also provide help for our country’s legislation and practice.This article consists of four parts: the first part, overview in jurisdiction of thetransnational corporation’s environmental infringement. The second part, the problemanalysis of the specific transnational corporations in the jurisdiction of environmentalinfringement cases. The third part, the causes of conflicts of jurisdiction of thetransnational corporation’s environmental infringement. The fourth part, thecoordination on conflicts of jurisdiction of transnational corporation’s environmentalinfringement.
