Research The Issues Of Pre-trial Procedure In Procedural Defense

In recent years, the concept of judicial procedural justice in our country began topenetrate and gradually deepened,with the attendant procedural defense alsoincreasingly favored by the people, to learn from our recently introduced severallaws and regulations. However, our procedural defense in both the legislative andjudicial practice there are still many problems affecting the implementation andprotection of suspects procedural justice for human rights, especially in the pre-trialcriminal proceedings. For example: Program prosecution authorities missing theappropriate sanctions violations, lawyers counsel investigation stage identity is notclear, the right to defense imperfect illegal evidence exclusion rules, suspects and thedefender is not able to protect the rights of the person, but rather repeated violationsand so on.Pre-trial procedures is a national initiative to prosecute ex officio authority to filea complaint stage, which includes investigation and interrogation and prosecution oftwo phases, it achieve both the functions of prosecution authorities complained andthe value of the Criminal goals. So, I put the pre-trial proceedings in defense ofprocedural issues as my master’s thesis topic. This article will introduce the LawyersAct of2007and amendments to the Criminal Procedure Law in this new main line,the concept of pre-trial proceedings from the procedural defense, characteristics,value commence litigation on procedural defense pre-trial proceedings are basedtheoretical basis for in-depth analysis, and then combined with a famous case onbehalf of the relevant domestic and international significance analysis of this topic inour legislation and judicial practice, the problems, the last corresponding proposedsome suggestions to improve this system and countermeasures.
