Research On Compulsory Defense System

The system of compulsory defense is an important part of the system of Counsel of Criminal Suit and an important manifestation of the development of the defense system to a certain historical period.The protection of human rights and the realization of due process has been paid more and more attention.Judging judicial justice is no longer a single standard of conviction and sentencing and the status of procedural justice is increasingly prominent.The establishment of the system of compulsory defense is to better protect the rights of the prosecuted meanwhile to restrict the abuse of the public power of the judiciary so that the accused can be tried in a fair and just judicial environment.Although China has established a designated defense system at this stage to guarantee the smooth exercise of the right of defense of the prosecuted,its strength in human rights protection has become insufficient and needs to be improved and reformed with the development of society.While the system of compulsory defense has been studied by the academic circle,they also call for the establishment of the system of compulsory defense to adapt to the development of the defense system.Through the comparative analysis of the system of compulsory defense and the existing relevant systems in China,this paper draws on the merits of foreign compulsory defense system to explore the establishment of the system of compulsory defense in line with China's national conditions.
