Study On Legal System Of Enterprise Credit Rating In China

Enterprise credit rating agencies are social intermediary organizations, which credit rating forrelated market transactions subject.Its main role is to be rated by comprehensive evaluation ofenterprise solvency and debt wishes to reveal enterprise default risk level. Enterprise credit rating isable to reduce information asymmetry and systemic risk, improve the effectiveness of operation of themarket and promote market transactions successfully completed. Enterprise credit rating reports notonly affect the main market transactions, but also improve the efficiency of the market, maintainmarket order, and promote the construction of social credit system.Throughout the course of development of enterprise credit rating, it is not difficult to find: theeffective assurance of the enterprise credit rating quality and the healthy and orderly development ofenterprise credit rating, which need market, government and enterprise credit rating agency’s ownefforts. At present, although the legal system of China’s enterprise credit rating has a foundation, butthere are still some issues need to be resolved, including the enterprise credit rating market accessstandards are not unified, regulatory mechanisms and legal responsibility mechanisms are inadequateand so on. Therefore, the thesis resumptively finish the status quo of China’s current enterprise creditrating market access, legal supervision and legal responsibilities, and a comparative analysis ofinternational legislation on enterprise credit rating practices, on this basis, we propose to improve ourenterprise credit rating market access system, the relevant legal supervision regime and the legalliability regime.
