| Arrest system as the criminal proceedings in one of the most stringent enforcementmeasures, in tracing and combating crime and maintaining social order played a veryimportant role, however, the most severe deprivation of liberty coercive measures, like adouble-edged sword, in the fight against crime, if applicable improperly bound infringepersonal rights and other legitimate rights and interests of citizens. Therefore, the question ofhow to measure simultaneously the arrest adequate protection of the human rights of citizens,is the theory and practice of criminal proceedings has long been constantly thinking about thetopic. In particular the new Criminal Procedure Code will "respect and protect human rights"clearly written into the General to further improve and strengthen the enforcement measuresin the Criminal human rights protection mechanisms, is to become a reality and urgent taskfacing us. This paper is divided into four chapters: the first chapter of the article discusses thebasic problems of the arrest of human rights protection system, that is the meaning andcontent of the arrest of human rights protection system, the role and significance of the arrestof human rights protection system. What is thus solved the arrest of human rights protectionsystem, why issue. After three chapters of the article is the focus of this study, the main stagefor the country in the arrest of human rights protection system problems by improving thearrests started, perform three basic procedures and remedies in the regulations and proceduresto protect the system program may infringe the arrest relates to the fundamental rights ofsuspects and the vital interests of the defendant.
