Food is an integral part of human existence substance, humans need human food likemissing on oxygen, food affect the survival of everybody in the community, not just thesocial and economic impact of the material, but also the majority of the people of the massesof the personal social health and life safety, food security and human survival are closelyrelated. However, in recent years, the crimes of producing, marketing toxic and harmfulfoods’ growth trends have no reduction. On the one hand, to survive, selling poisonous andharmful food crimes involving a wide range of surfaces economic crime, long-term nature ofthis crime, concealment, potentially harmful salient features involving means, criminal acts,criminal object wide, in the event of food safety hazard events, implicated in a series ofproblems. On the other hand, the market itself has spontaneity, food producers and sellers inorder to pursue their own interests, in order to pursue the lowest cost, highest profit and themajority of people’s lives and health of people indifferent. Such as cooking oil incidentoccurred this year on the market fully reflects the economic food producers and sellersunderstand the objective world there are limitations. So, when the market economy cannotbe self-discipline, which requires legal norms to play its role in criminal acts.China’s current Criminal Code provisions144: producing and selling poisonous and harmfulfood crimes, criminal law on the crime circles there are more in-depth study, I believe thatthis crime still exists imperfections, this paper studies the probe from the three aspects of thiscrime, the first part Analysis of producing and selling poisonous and harmful food crimesconstitute the main feature, the second part of the analysis of the crime of complicity inshape, find the problem from the analysis, based on China’s actual situation, to think of foodfrom the reality of crime problem.
