Food safety is the material basis of human existence,in recent years,the outbreak of various food safety incidents in China,leading to the national concern and concern about food safety increasing.With the aim of pursuing food quality and safety,the author analyzes the difficult problems in judicial practice the crime of producing and selling toxic and harmful food on the existing theoretical basis.First of all,it expounds the legislative evolution of this crime in various periods,and the influence of different policies on food safety crime is different in different periods.Secondly,the constituent elements of this crime are analyzed,the scope of toxic and harmful non-food raw materials is defined,the relationship between toxic and harmful,and the determination of the scope of non-food raw materials,and the analysis of the practice of the crime "production","sales" and "indostination" is analyzed,and the criterion of "knowing" is clearly defined in subjective aspects.Once again,the author made a judgment on the crime,thought that the crime belongs to the abstract dangerous crime,analyzed the three unfinished forms of this crime,analyzed the different criteria of the crime and its crime,and solved the related problems through comparison from the judicial practice.Finally,this crime penalty on the application of fine and qualification penalty,put forward their own views...
