On The Outskirts Of The Rural Collective Economic Organizations And Their Ownership Change, Development Issues And Legislative Proposals

In recent years, with the continuous expansion of city of suburban land is expropriated,especially in Beijing, Shanghai, Guangzhou and other first-tier City, the area of thefarmers lost their land, these peasants part of identity into urban residents, farmers arestill a part of farmers’ identity, but no longer rely on the land for a living, they began to relyon company dividends, collect rent as the main source of livelihood, their livingenvironment, way of production, management system, with the development of city hasundergone tremendous change. I am as a lawyer through the reform scheme in suburbsof Beijing city part of the rural collective economic organizations and propertydevelopment work, to understand Beijing suburb rural land is required after the collectiveeconomic organizations lead farmers for the enterprise, system of property right ofcollective economy and before the occurrence of great changes, the original "total" totalsystem no longer adapt to change after the market development, how to protect theselandless "farmers" and "residents" life and improve the level of rural urbanization,maintaining the stable and sustainable development, the government should establish thecollective economic system adapted to the development of market economy, and promotethe rapid development of rural collective economy, which requires the ownership of ruralcollective economy property right clear, the assets into equity,"farmers" and "people"become shareholders, the original "total" has changed the system "by copies of"ownership, use now enterprise management mode, improve the operation efficiency ofassets, will increase the value of collective assets. But the existing law already cannotsatisfy the rural collective economic organizations after the reform of property right systemof the rule of law and the environment.In this paper, through the history of City suburb rural collective economic organizationsand their property, defects existing in the traditional property right system of the outskirtsof the city, the rural collective economic organizations and the reform of property rightsystem of the form, characteristics, problems of rural collective economic organizationsand the reform of property right system of the performance and, combined with theussian rural collective assets restructuring the lessons of failure, this paper the ultimategoal of city outskirts of the rural collective economic organizations and its propertychanges. Put forward the legislative suggestion and adapt the existing rural collectiveeconomic organization, the rural collective economic organizations after the reform in the healthy growth of the rule of law environment.
