The Residential Surveillance System Study

Residential surveillance system is coercive measures of a criminal contentious field ofcriminal justice in China, changes in the criminal procedure law in2012, because of itsapplicable conditions and bail the same, often by the judicial practice department left out inthe cold. The criminal procedure law amended in2012to be refined in the conditions of itsapplication, execution supervision, legal aspects, hoped the measures to prevent the wrongdetention, play a positive role in reducing the rate of pre-trial detention. But because theregulations in some ways is not reasonable, not to establish the relevant supporting measures,residential surveillance system does not like the Legislature are expected to play its due role.Criminal coercive measures is the most easy to infringe the basic rights of citizens in thecriminal procedure, from the protection of their own rights and interests from illegalviolation point of view, the criminal compulsory measures must be a legal field are veryconcerned about the community. Therefore, in the collection of data selection, in addition toacademic circles related literature reviews, also focus on the collection of the social peopleof the system views. To comb analysis in the study of the existing literature, and the effectsof the operation of the system for nearly a year of judicial practice status, also related to theextra territorial system to collect, the improvement of the relevant judicial interpretations, theestablishment of supporting measures and other aspects of the improvement of residentialsurveillance system put forward its own proposals.
