As one of the five major compulsory measures in China's criminal procedure,residential surveillance criminal compulsory measures have existed two different views in the legal circles since the first revision of the Criminal Procedure Law.In the revision of the Criminal Procedure Law in 2012,the residential surveillance system was also retained and improved.The applicable conditions of residential surveillance are clearly defined and refined,and the notification obligation when residential surveillance is adopted and the reduction of the term of imprisonment are added.In addition,in view of the existing difficulties in execution before,the technical supervision methods for monitoring the future of residence are specially stipulated.With the help of modern science and technology,the monitoring of residence execution is more operational and the waste of judicial resources is reduced.Generally speaking,the new criminal procedure law in 2012 is much stricter and more scientific than the criminal procedure law of 1996.This article is mainly divided into four parts to study the surveillance residential system.The first part is mainly about the development history of residential surveillance system,the value analysis of residential surveillance system,and the comparison between residential surveillance system and bail pending,arrest and other measures.The second part further analyzes the application status of residential surveillance system and existing problems in practice through cases.The third part mainly analyzes and compares the regulations and application of similar residential surveillance system in other countries and regions in the world,and summarizes and absorbs the experience to promote the development and improvement of China's residential surveillance system.The fourth part mainly proposes the way and method to solve the problem of residential surveillance in practice.
