As a big consumer market under the system, effectively safeguarding consumerinterests is an important way to achieve long-term development of the marketeconomy。To safeguard the legitimate interests of consumers, China has established a"Law Against Unfair Competition Law" as the representative of a series of laws andregulations in the legislation, the Anti-Unfair Competition Law on Consumer RightsProtection major legislative purpose and resize the object from two aspects maderelevant exposition。From the point of view is to set goals in order to maintain areasonable market order to run, to build a fair and equitable market environment forunfair competition in the market to create an effective deterrent to provide legal basisto safeguard the legitimate rights and interests of consumers; This law is mainlyapplied to acts of unfair competition in this particular condition, to adjust operatorsand regulators, operators or both consumers and operators to engage in complexsocial relations of commodity exchange process。"Anti-Unfair Competition Law" and "Consumer Protection Law" differ in theapplication phase, the method is mainly applied to stop the advance of impropercompetitive behavior and avoidance phase, indirect protection of consumer rights。This method not only effectively avoid unfair competition in the market place, and thelegitimate rights of consumers to provide a legal basis。China’s current "Anti-Unfair Competition Law" there are still many loopholes inits legislation, law enforcement and the specific practical level, needs to bestrengthened to improve and perfect。With the increasing acts of unfair competitiondeveloped network, is typical of some of the legitimate rights and interests ofconsumers against triggered a focused discussion and public concern。How to solve these problems,"Anti-Unfair Competition Law" how to furtherimprove, all we need for profound reflection。From a practical level and consumergroups to develop and carry out practical interests to change the law, is to promote the "Anti-Unfair Competition Law" fundamental way to improve。This paper aims to explore the Unfair Competition Law safeguard the legitimaterights and interests of consumers in their daily lives specific performance, exploringboth internal contact dialectical way of thinking。Through a number of countries inEurope and America and the Asia Pacific region specific case studies, summarized thehistory of the Anti-Unfair Competition Law in the development process of countries,comparative analysis of national legislative basis and safeguards of the Act, to learnadvanced concepts and practices related。 Finally, focus on the Anti-UnfairCompetition Law on Consumer Rights Protection reality, found weak and inadequateand unfair competition law attempts to improve and perfect the constructivecomments or suggestions, which will effectively safeguard consumer implement thoseinterests into practice...
