| With the deepening of reform and opening up, gradually acceleratingurbanization, rapid rural to urban areas, exacerbating the shortage of urban landwith limited resources. City building converted to a higher floor, the developmenttrend of high-gathering, the residents living in the original becomes highlydispersed settlements. Comes easily produce some disputes on the ownership andmanagement has become tricky. Residents who live in the same building or the samesmall area, sharing the same building, the same cell, and the correspondingfacilities and other resources throughout the building and its ancillary facilities onthe formation of common rights and obligations of all, originally a single right ofeach unit is divided into the right class, enjoyed by residents, respectively. Thus,they constitute a basis in reality produced condominium ownership.In order to properly deal with the reality of condominium ownership disputes,China promulgated in2007, the "Property Law", which explicitly written law ofcondominium ownership, in2009promulgated the relevant judicial interpretation.These provisions conform to the urbanization process in China, and to some extentsolve the underlying problem, but due to the complex reality of the situation,"Property Law" and relevant judicial interpretations there are still a lot of need for acomplete place.For the study of the condominium ownership regime, the first of its concept, adescription of the nature of condominium ownership, characteristics andcomposition, depicting its development experiences from a historical perspective.Secondly, three were from the part of condominium ownership, proprietary, andmembers were entitled to the right to start, one by one analysis to be explored.Finally, while summing up the above conclusions on the implementation oflegislation and other aspects of condominium ownership to make elaborate, discussthe legal aspects for the vesting in the greenbelt, parking attribution and relief andother ways people have been infringed, the current regulations deficiencies thatexist, the paper also puts forward the corresponding improvement suggestions tobenefit future legislation. |
