The Research On Copyright Attribution Of Work Duties

As the development and research of copyright become more and more popular,it gradually grows into a quite complete system. Now there are multiple branches incopyright. Among all branches of copyright, the protection of copyright in works ofposition is quite new. However, the potential of the development of it is large.Through the in-depth study and research of works, the author found that, in practice,as the increasing awareness of protection of works of people, the resulting copyrightdisputes also increased; In the theoretical circle, on the issue of the position workscopyright ownership, different scholars have different views. There is prolongeddebate about the copyright ownership of position work. As the development of scienceand technology in the society, the laws of copyright ownership of position worksshould also be timely updated. Through the analysis and induction of theory andpractice of works copyright in China, the author believes that there is still deficienciesin the current copyright law regulations about post attribution in our country, such asthe definition of office work, the unit works, legal person works is vague; thestandards of the law applicable of position work is different; different sentences ofthe same case; limited rights and interests of authors; the impeded propagationchannel and so on.Through the painstaking analysis of domestic and overseas scholars and foreignrelated laws and relevant international treaties and conventions, research andprotection system of copyright ownership of office work, and the study of theadvanced achievements of research and practice, combining the reality of China, theauthor would like to make a summarizes about the defects in copyright ownership ofthe works. The conclusion of this thesis may provide a small hint of the improvementof the laws of works copyright ownership system in China and the construct a more suitable system for the position of the copyright protection of works in our country.What’s more, the author put forward the corresponding legislative and legalapplication of measures, hoping to provide suggestions for the improvement of lawsof the copyright attribution of position works.
